General terms and conditions of Eisei

General
- These conditions apply to every offer, quotation and agreement between Eisei and a counterparty, unless parties have deviated from these conditions explicitly and in writing.
- The order online or via e-mail from the other party to Eisei counts as acceptance of the general delivery conditions of Eisei.
- General terms and conditions of third parties are not accepted by Eisei, unless explicitly and in writing.

Offers and agreements
- All offers are without obligation and are made in written form; this also includes the offer via e-mail and internet.
- All prices mentioned are in euros and include VAT, unless explicitly stated otherwise and always subject to typing errors
- The offers and prices are subject to change without notice. This does not apply to orders placed before the time of change, unless there is ascendancy.
- The agreement between the other party and Eisei commences at the moment that the other party delivers an order to Eisei via the website, by e-mail or verbally. By submitting an order, the other party accepts the general terms and conditions of Eisei.
- In the unlikely event that products or services from the order are not in stock or available, Eisei will inform the other party by e-mail or orally and the order will be adjusted after consultation between both parties.
- The agreement between the other party and Eisei is binding when Eisei delivers an invoice to the other party by e-mail or in writing.
- Payment
- Payments to Eisei can be made through iDeal

Terms of delivery
- The order will be delivered after payment of the invoice has been received by Eisei.
- Orders placed and paid are shipped within 2 days.
- In the unlikely event that products are not in stock, the other party and Eisei may agree to have the products delivered as soon as possible.
- If it is agreed to send the order, this will be done via PostNL or your own delivery service. The addressing is taken from the data that the other party has supplied by ordering via the website. Eisei takes care of packaging the order with care, but is not responsible for damaged delivery of orders due to errors of the carrier, the other party or others.
- Orders are only sent by letterbox mail unless otherwise agreed in writing.
- We send letterbox mail in a packaging that meets the (maximum) formats for letterbox mail, as determined by PostNL. If the order cannot be delivered due to the different size of the other party's own letterbox, Eisei will only resend the item if the additional shipping costs have been paid by the other party.
- Orders are shipped in the manner indicated on the invoice.
- The color scheme of delivered products is subject to change by the product manufacturer. Eisei tries to keep the product photos as recent as possible, but is not responsible for any (color) differences between the photo and the delivered product. You always have the right to return the product (in original, unopened packaging) as described in article 5.3.

Warranty, complaints, exchanges and returns (right of withdrawal)
- Eisei checks the order to be delivered in advance and guarantees that it has been sent in good condition. Eisei is not responsible for damage to the order due to errors by the carrier, a foreign partner, other party or others.
- Eisei and the other party cannot invoke the warranty if damage is caused by incorrect use of products.
- If the other party is not satisfied with the order received, it must indicate this within 14 days after receipt of the order by, for example, sending an e-mail to Eisei (info@eisei.nl).
- You have the right to withdraw your contract without giving any reason within 14 days after the day on which you (or a third party designated by you) physically take possession of the product. Returning is possible within a period of 14 days after cancellation and is at the expense of the other party. Eisei will repay the costs paid by the other party for these items within 14 days after cancellation. If the entire order is returned, the full purchase amount will be refunded, including the original shipping costs of the order. If only part of the order is returned, the purchase amount of the returned items will be refunded, but no refund of the shipping costs will be made. We will refund you with the same payment method as you used to perform the original transaction, unless expressly requested otherwise. No additional costs will be charged for the refund.
- Exchanging an order is free of charge if this occurs on the basis of errors on the part of Eisei, for example by delivering a different item than the other party has ordered. In that case, too, the products must be returned in their original, unopened and undamaged packaging. Eisei reserves the right to make exceptions to this depending on the situation.
- Eisei guarantees good product quality upon shipment.
- Eisei handles complaints according to the following complaints procedure. Complaints about delivered products or the performance of the agreement must be made in writing or by e-mail to Eisei, if possible with visual material when a product shows defects. Complaints will be answered within 14 days of receipt. If more time is required to resolve the complaint, Eisei will contact the other party about this within that set term. The European Commission offers an online dispute resolution platform for consumers, which can be found at http://ec.europa.eu/odr . We do not participate in a dispute resolution procedure.

Liability
- Eisei does not accept any liability for damage to persons as a result of incorrect use of delivered products, or incorrect follow-up of the user manual by the other party.
- Eisei is not liable for damage to items as a result of improper handling, normal wear and tear of products, or damage caused by others.
- Eisei is not liable for damage to objects, articles or products that are not supplied by Eisei, or that are the result of an order or product supplied by Eisei.

Ascendancy
- Ascendancy means any circumstance that prevents Eisei from fulfilling its obligations to the other party in time. If this situation lasts longer than 30 days, the other party can cancel the order free of charge.
- If there is force majeure, the other party will be informed of this as soon as possible.

Law
- Dutch law applies at all times to all agreements, articles, services and conditions of Eisei.
